Common Building Questions

 

 

Why Do I Need A Building Permit?  Building permits are required as per Section 105.1 of the 2000 International Building (adopted by Ordinance 2000-15). The Building Official will make a final determination as to whether or not a permit will be needed. 

 

What Work is Exempt from a Building Permit?   The following work is exempt from a building permit, as per Section 105.2 of the 2000 International Building Code (adopted by Ordinance 2000-15).

 

1.

One-story detached accessory structures used as tool and storage sheds, playhouses and similar uses, provided the floor area does not exceed 120 square feet (11.15m).

2.

Fences not over 6 feet (1829 mm) high.

3.

Oil derricks.

4.

Retaining walls which are not over 4 feet (1219 mm) in height measured from the bottom of the footing to the top of the wall, unless supporting a surcharge or impounding Class I, II, or III-A liquids.

5.

Water tanks supported directly upon grade if the capacity does not exceed 5,000 gallons (18,927 L) and the ratio of height to diameter or width does not exceed 2 to 1.

6.

Sidewalks and driveways not more than 30 inches (762 mm) above grade and not over any basement or story below and which are not part of an accessible route.

7.

Painting, papering, tiling, carpeting, cabinets, counter tops, and similar finish work.

8.

Temporary motion picture, television, and theater stage sets and scenery.

9.

Prefabricated swimming pools accessory to a Group R-3 occupancy, as applicable in Section 101.2, which are less than 24 inches (610 mm) deep, do not exceed 5,000 gallons (19,000 L) and are installed entirely above ground.

10.

Shade cloth structures constructed for nursery or agricultural purposes and not including service systems.

11.

Swings and other playground equipment accessory to one- and two-family dwellings.

12.

Window awnings supported by an exterior wall of Group R-3, as applicable in Section 101.2, and Group U occupancies.

13.

Movable cases, counters, and partitions not over 5 feet 9 inches (1753 mm) in height.

 

Unless otherwise noted, separate electrical, plumbing, and or mechanical permits may be required for the above-exempted items.  Check with your Building Official for verification.

 

Do I Need to Contact Anyone if I Want to Dig in My Yard?  YES.  You will need to contact Diggers Hotline of Nebraska.  Diggers Hotline will walk you through a set of questions, such as where and when you plan to dig and the reason why you are digging. Diggers Hotline will then notify all city utilities, the cable company, and the gas company as to where and when you plan to dig.  The appropriate entities will then come to your property and mark for any utilities.  You may contact Diggers Hotline at 1-800-331-5666.

 

What if I Wish to Raze an Existing Structure, Do I Need a Permit? The answer is yes. According to Section 18-2 of the City of Wayne Municipal Code, it shall be unlawful for any person to demolish or raze any building or part of a building in the City of Wayne, Nebraska without first obtaining a permit from the building inspector.  An application may be obtained from the Building Official.  In addition to the application, a non-refundable permit fee of $10.00 is required. The applicant shall also be required to post a bond in the amount of $1.00 per total floor space of the existing structure, excluding the basement, to be demolished or razed.  The bond is refundable, conditioned upon all city utilities being properly disconnected and that all demolished or razed material be properly removed and disposed.  Please contact the Building Official at 402-375-1733 for more information.

 

Is a Permit Required to Move a Structure within the City?  Yes, a permit is required.  A permit may be obtained by contacting the Building Official at 375-1733.  In addition to the application, a permit fee of $100 is required, along with a permit bond in the amount of $10.00 per square foot.  The permit will be issued subject to the owner’s/mover’s compliance with all building, plumbing, electrical and fire codes, municipal codes, and zoning and subdivision ordinances of the City of Wayne.  Please contact the Building Official at 402-375-1733 for more information.
