Planning Commission Meeting Minutes
Monday, March 1st, 2004
Chair Jack Hausmann called
the regular meeting of the Wayne Planning Commission to order at 7:30 p.m., on
Monday, March 1st, 2004, in the Council Chambers of the Municipal
Building. Roll call was taken with the
following members present: Kyle Nelson,
Darrell Miller, Marty Summerfield, Bill Reeg, Sharon Braun, Marie Mohr, Don
Endicott, Chair Jack Hausmann, and Chief Inspector/Planner George Ellyson. Absent:
Vicki Pick.
Motion made by Commissioner
Miller and seconded by Commissioner Braun to approve the minutes, with one
correction. Commissioner Braun wanted
the minutes of February 2, 2004 to include her comment of the following
"Commissioner Braun opined that she feels as if the Commission is pressured to
make decisions quickly." Chair Hausmann
stated the motion and seconded. All
were in favor; motion carried.
Inspector Ellyson noted for
the Commission that he will be attending the NPZA Conference at the end of
March, first of April. Chair Hausmann
opined that he has attended the conference once and there are areas where
programs are set for Planning Commissions.
If you see something interesting, it may be worth it.
Chair Hausmann stated the
next meeting will be Monday, April 5th at 7:30 p.m. Commissioner Reeg stated that he would not
be able to attend the April meeting.
Chair Hausmann stated that
the time was at hand for the first public hearing at 7:35 p.m. for the Use by
Exception request for storage units and mini-warehouses at 118 East 2nd
Street (former Liquor Barn location) under Section 90-394(10) of the Wayne
Municipal Code, applicant James R. Milligan.
Chair Hausmann stated that
Mr. Milligan was unable to be present at the meeting and Chair Hausmann asked
if anyone would like to speak on his behalf.
Inspector Ellyson informed the Commission that the request came to him
about a month ago and Mr. Milligan wants to create individual 60 to 70 square
foot storage units in the back part of the old liquor barn store. Currently there is a carryout only pizza
place being modified and should be done soon and that area is located out of
the front portion of the building. The
storage units are similar to those that Mr. Garry Poutre put in the former meat
locker. This request is required to
come before the Commission as a use by exception in the business zone.
Commissioner Summerfield
questioned how the storage units will be accessed. Inspector Ellyson was uncertain when the storage units could be
accessed, as far as hours open. Inspector
Ellyson opined that there would be a public door as there is a public corridor.
Chair Hausmann questioned if
there are certain rules for lighting of the facility. Inspector Ellyson stated that there are no specific building
codes for the lighting. Mr. Milligan
has stated to Inspector Ellyson that he will allow and state in the contracts
that any flammable storage, such as paint, etc. would be disallowed. The State Fire Marshall has looked at the
plans and the building is fine with both the plans and the facility.
There being no further
discussion, Chair Hausmann closed the public hearing and opened the discussion
up to the Commission.
Commissioner Mohr opined that
she liked the idea of not storing flammable material in the facility, but
questioned how it would be enforced.
Inspector Ellyson noted that Mr. Milligan stated it would be part of the
contractual agreement with those who rent the storage units. Inspector Ellyson was unsure how often the
units would be monitored, but it could be one of the conditions that the
Commission places on the use, if it is approved.
Commissioner Braun questioned
how the items would be insured of they were flammables. Commissioner Summerfield opined that if you
have someone from out of town renting one of those units, how could you get
them to come every two months or so to verify what is being stored there. Also, there is a privacy issue with what is
being. Commissioner Summerfield noted
that another storage unit facility in town, the owner of them is not allowed to
look at the contents of the units.
After so many months of unpaid rent, the owner may enter the units and
remove the contents for sale.
Motion made by Commissioner
Braun and seconded by Commissioner Summerfield to approve and forward the Use
by Exception request for storage units and mini-warehouses at 118 East 2nd
Street (former Liquor Barn location) under Section 90-394(10) of the Wayne
Municipal Code. Chair Hausmann stated
the motion and second. All were in
favor, motion carried.
Chair Hausmann stated the
time was at hand for the second public hearing to update the City of Wayne
zoning map for corrections from the hand-drawn plat map to the current GIS
mapping system. Inspector Ellyson
brought the Commission up-to-date on the issue. At the previous meeting, discussion took place on the actual
zoning line of Cityside Addition.
Inspector Ellyson informed the Commission that Cityside Addition was in
fact zoned R-4 and the only area needing to be rezoned was near the fire
hall. The zoning line needs to be moved
to the west property line of the fire hall to place the fire hall in the B-1
zone and not the R-4 zone.
There being no further
discussion, Chair Hausmann closed the public hearing.
Motion made by Commissioner
Summerfield and seconded by Commissioner Nelson to approve and forward the
updates to the City of Wayne zoning map for the the corrections from the
hand-drawn plat map to the current GIS mapping system. Chair Hausmann stated the motion and second. All were in favor, motion carried.
Chair Hausmann opened the
third public hearing regarding amending the Wayne Municipal Code Article XI,
Exceptions and Conditional Uses, Section 90-831 General Powers, and Section
90-834 Public Hearing by Council. Inspector
Ellyson stated that in the Commission's packet there is a draft of the proposed
changes, with the new language in bold type and the deletion in
strikethrough. The amendments would
send all use by exceptions to the Commission and the Council.
There being no further
discussion, Chair Hausmann closed the public hearing.
Motion made by Commissioner
Reeg and seconded by Commissioner Miller to approve and forward the amendments
of the Wayne Municipal Code Article XI – Exceptions and Conditional Uses,
Section 90-831 General Powers and Section 90-834 Public Hearing by
Council. Chair Hausmann stated the
motion and second. All were in favor,
motion carried.
The final item on the agenda
is the discussion of Section 90-710 Parking Regulations. Inspector Ellyson stated that this
discussion item had been previously discussed at the joint meeting with City
Council.

Braun and seconded by Commissioner Summerfield to adjourn the meeting. Chair Hausmann stated the motion and
second. All were in favor, motion carried
and the meeting was adjourned.
