Planning Commission Meeting Minutes

Monday, April 5, 2004

 

Chair Jack Hausmann called the regular meeting of the Wayne Planning Commission to order at 7:00 p.m., on Monday, April 5, 2004, in the Council Chambers of the Municipal Building.  Roll call was taken with the following members present:  Kyle Nelson, Darrell Miller, Marty Summerfield, Bill Reeg, Sharon Braun, Marie Mohr, Don Endicott, Vicki Pick, Chair Jack Hausmann, and Chief Inspector/Planner George Ellyson.  Members of the Wayne City Council were present, as well as Lance Webster, Chief of Police, City Administrator Lowell Johnson, City Clerk Betty McGuire, and City Attorney Mike Pieper.

 

Public in attendance were Jeff Morlok, Gary Van Meter, Ron Harder, and Mr. & Mrs. Ed Brogie.

 

Motion made by Commissioner Braun and seconded Commissioner Mohr to approve the minutes as stated.  Chair Hausmann stated the motion and second. All were in favor; motion carried.

 

The only item on the agenda was the discussion of several proposed changes to Chapter 90 Zoning of the Wayne Municipal Code.  After much discussion between the Planning Commission and City Council, the following revisions were proposed to Draft 5 of the proposed changes:

 

Ø      Add a cross-reference to the definition for Category One and Category Two in Section 90-10 Definitions as follows:  See Section 90-761 Non-Conforming Residential Uses

 

Ø      Add to Terrace Parking of Section 90-10 Definitions the following:  Parking surface and approach shall be concrete or asphalt, a minimum of 6" thick placed on a minimum of 2" or 3/8" or larger diameter compacted gravel base.

 

Ø      Section 90-205 Exceptions R-1 (13)(a); Section 90-235 Exceptions R-2 (9)(a); Section 90-265 Exceptions R-3 (12)(a); Section 90-294 Permitted conditional uses R-4 (2)(b)(1); Section 90-315 Special exception uses R-5 (7)(b)(1); Section 90-354 Exceptions B-1 (9)(d)(1); Section 90-394 Exceptions B-2 (10)(h)(1); Section 90-424 Exceptions B-3 (13)(d)(1) – shall be amended to read as follows:  Occupy one empty bedroom per tenant to a maximum of two tenants.

 

Ø      Section 90-205 Exceptions R-1 (13)(d) – shall be amended to read as follows:  Upon vacating or sale of a Category One dwelling unit by the owner, this structure shall return immediately to a single dwelling unit status and forfeits all conversions conditions previously granted.  New owner(s) that intend to expand this unit to Category One status shall first meet all requirements of this code.  However, the new owner(s) will

need to state their intent to utilize the structure as a Category One and will need to re-register the structure upon purchasing.

 

Ø      Section 90-235 Exceptions R-2 (9)(d) – shall be amended to read as follows:  Upon vacating or the sale of a Category Two dwelling unit by the owner, this structure shall immediately return to a single dwelling unit status and forfeits all conversions conditions previously granted.  New owner(s) that intend to expand this unit to Category Two status shall first meet all requirements of this code.  However, the new owner(s) will need to state their intent to utilize the structure as a Category Two and will need to re-register the structure upon purchasing.

 

Ø      Section 90-265 Exceptions R-3 (12)(d) - shall be amended to read as follows:  Upon vacating or the sale of a Category Two dwelling unit by the owner, this structure shall immediately return to a single dwelling unit status and forfeits all conversions conditions previously granted.  New owner(s) that intend to expand this unit to Category Two status shall first meet all requirements of this code.  However, the new owner(s) will need to state their intent to utilize the structure as a Category Two and will need to re-register the structure upon purchasing.

 

Ø      Section 90-294 Permitted conditional uses R-4 (b)(2)(b)(4) - shall be amended to read as follows:  Upon vacating or the sale of a Category Two dwelling unit by the owner, this structure shall immediately return to a single dwelling unit status and forfeits all conversions conditions previously granted.  New owner(s) that intend to expand this unit to Category Two status shall first meet all requirements of this code.  However, the new owner(s) will need to state their intent to utilize the structure as a Category Two and will need to re-register the structure upon purchasing.

 

Ø      Section 90-315 Special exception uses R-5 (7)(b)(4) - shall be amended to read as follows:  Upon vacating or the sale of a Category Two dwelling unit by the owner, this structure shall immediately return to a single dwelling unit status and forfeits all conversions conditions previously granted.  New owner(s) that intend to expand this unit to Category Two status shall first meet all requirements of this code.  However, the new owner(s) will need to state their intent to utilize the structure as a Category Two and will need to re-register the structure upon purchasing.

 

Ø      Section 90-354 Exceptions B-1 (9)(d)(4) - shall be amended to read as follows:  Upon vacating or the sale of a Category Two dwelling unit by the owner, this structure shall immediately return to a single dwelling unit

Ø      Section 90-424 Exceptions B-3 (13)(d)(4) - shall be amended to read as follows:  Upon vacating or the sale of a Category Two dwelling unit by the owner, this structure shall immediately return to a single dwelling unit status and forfeits all conversions conditions previously granted.  New owner(s) that intend to expand this unit to Category Two status shall first meet all requirements of this code.  However, the new owner(s) will need to state their intent to utilize the structure as a Category Two and will need to re-register the structure upon purchasing.

 

Ø      Section 90-761 Nonconforming residential uses (b) – the following shall be added as item (b)(3):  All single family residential and duplex dwelling units that are rental structures, shall be subject to the code requirements for registration.

 

Ø      Section 90-761 Nonconforming residential uses (i) – the following shall be deleted:  Any applicant whose application is denied may appeal to the Board of Adjustment, in writing, within thirty (30) days of the decision of the City Council.

 

The proposed changes to Draft #5 will be brought back to the next regularly scheduled Planning Commission meeting as Draft #6.

 

There being no further discussion, motion was made by Commissioner Reeg and seconded by Commissioner Pick to adjourn the meeting.  Chair Hausmann stated the motion and second.  All were in favor; motion carried and the meeting was adjourned.
